Estate of North v. Napier, et. al. Ms. Richardson & Mr. Epperson secured a dismissal for three KSP officers who were sued for wrongful death following a police pursuit. The Court ultimately found that the officers’ actions were discretionary rather than ministerial, and, upon completion of the officers’ discovery depositions, determined that the Plaintiffs could not meet their burden to show that the officers acted in bad faith. As such, the officers were determined to be immune from suit and this matter was dismissed with prejudice.
