Wilson v. WF Morgan Company, et al. Zack Turpin successfully obtained summary judgment after a vehicle owned and operated by his clients allegedly backed into a transport van containing the Plaintiff. While the Plaintiff alleged to have suffered injuries as a result of the accident, he failed to timely serve responses to Requests for Admissions that asked that he concede the Defendants were not at fault for the accident and that he did not sustain any injuries or damages as a result. Defendants then asked the Court to deem the information sought by those Requests for Admissions admitted and grant summary judgment in their favor. While Plaintiff’s Counsel asked the Court to allow his client to answer the overdue Requests for Admissions and deny the Motion for Summary Judgment, he failed to respond to Defendants’ Motion for Summary Judgment within the time permitted by the Local Rules. As a result, the Court deemed the information sought by those Requests for Admissions admitted and granted summary judgment in favor of the Defendants thereby dismissing all claims against them with prejudice.
