Bauer v. Cole Engineering Solutions, Inc., et al. Melissa Richardson and Ryan Glass successfully obtained summary judgment for their client. Plaintiff alleged he fell when a steel building component, which was part of a stairway assembly, was moved and placed in the walkway of a building by an unknown person. Plaintiff alleged all Defendants were solely at fault for the accident by either creating or allowing the condition to exist on the premises. Cole Engineering was retained to provide structural analysis and design recommendations for the stainless steel/glass guardrails and was never on the premises. The Court ruled for those reasons, Cole Engineering did not exercise possession or control over the site, materials, or the steel component. Additionally, the Court ruled the Plaintiff failed to produce evidence or factual support for his assertion that Cole Engineering was involved in the placement of the hazard which caused his fall.
